Can I receive unemployment benifits if you are fired for being “charged” with a crime (not work related)?
I was fired due to being charged with a crime. I AM NOT CONVICTED yet. I am a truck driver, and the crime is not work related and has nothing to do with driving or my CDL. I live in Michigan. I got a letter in the mail from the unemployment office saying i qualify for a benifit year but they also sent a Questionare asking why. what im wondering is if they will deny me because of this legal issue. Oh yeah i also have had a backround check and nothing is on my record.
If you were charged with a crime but not convicted, you should be eligible for UI benefits. As you will note, on page 5 of the booklet noted in Source below, almost everything MI says about potentially disqualifying actions deal with the workplace, although they do say that “being fired for absence due to conviction and imprisonment” will disqualify you. As this does not apply in your situation, you should be approved. Please note, in your question you state, “I AM NOT CONVICTED yet.” The “yet” is what could be a problem. It appears that you anticipate being convicted. Once/If you are, your benefits will likely terminate.
