What do I do if I got in a car accident when I’m on probation?
I got a speeding ticket earlier on this year, and have gone to court where they put me on probation for 90 days and take defensive driving. But I just got into a car accident a week after and I believe that I was not guilty. But the officer gave me a ticket for running a red light, which cause the accident. What happen was that I didn’t have a witness, while the other people have a lady for a witness (she came like 30 mintues later after the accident that she was shopping and said that she was three cars down from the other car and that it was a green light on their side.) So what do I do? I’m scared that this will go on my driving record and stay there for life. I am at a disadvantage if I fight this out in court, so please if there is any officers or lawyers can give me some professional informations on this. Thank you everybody who can answer my question. (I’m like extremely scared right now, so please help me.)
The truth hurts. And unfortunately, the truth is, based on what you’ve said, your chances of prevailing in court are slim to none. That said, the conviction will become part of your driving record and may also constitute a violation of your probation. This could mean a heightened suspension period for your license, additional fines/fees and more mandatory defensive driving classes. I wish I had good news, but from your story, that’s the case.
Your best bet is look the judge in the eye and try to convince him/her that your story is not only true, but that the witness may be discredited. Ask the witness where she was and look for holes in her story. Find out if she wears glasses, etc.
